1 - Start price is in United States American dollars: any bid under start price will not be considered.
2 - The auction is run exclusively on behalf of and for the account of third parties. The auctioneer is authorized to pursue in his own name all rights and claims arising from the vendor’s instructions on the knocking down of lots.
3 - Lots are knocked down to the highest bidder.
Equal bids are determinated by drawing lots. No
responsibility is assumed in case of negligence, error or fault in the
execution of written bids.
4 - The cost of the postage, packing
and insurance will be invoiced to the buyer.
Additional postage costs
may be applied for excessive weight.
Please E-mail BAS STAMPS AUCTIONS for exact postage and handling rates.
Notice: please inform us with your
bid which postage service option you prefer to receive your lots.
All bids are in US dollars.
5 - Bidders are obliged to take over
lots knocked down to them.
Invoices must be paid immediately. Lots remain the property of the seller
until payment has been made in full, which includes clearance of any checks
and payment of any bills of exchange.
6 - If payment is delayed interest
will be charged at 2% per month of part month.
If the buyer fails to pay promptly
or does not take up the lots, the auctioneer is entitled, after due warming,
to demand damages from the buyer for no-fulfillment of contract. In this
case, the auctioneer is entitled to demand flat rate damages of 30% of
the hammer price in compensation for forgone commission and for expenses
incurred.
7 - Shipping of lots is at buyer’s
cost.
The risk passes to the buyer as soon
as the lots are handed over the Post Office. If the lots are ready for
shipment but removal is delayed for reasons, beyond the auctioneer’s control,
the risk passes to the buyer upon receipt of notice that the lots are ready
for shipment.
8 - Descriptions, numbering and catalogation are done according to Scott
catalogue, unless otherwise stated.
Descriptions of lots are prepared
with the greatest care to the best of the auctioneer’s knowledge; they
are not however to be taken as statements of facts.
No claims of any sort, in particular
relating to quality and quantity may be made in respect collections, accumulations
and the other large lots. Unless stated otherwise, quoted catalogue values
are not biding.
Lots already stated to contain faults
couldn’t be returned by reason of further small faults. Defects, which
can be seen from illustrations (margins, perforations, cancellations, centering,
etc.), cannot be subject of complaints.
No complaint will be considered if
lots or stamps have been altered. Alterations include removal of hinges,
hinge remainders or paper adhesions, immersion in water, treating with
chemical’s and the addition (or removal) of marks of any sort.
If a lot is purchased subject to an
expert opinion, the cost of which will be paid by the buyer, the auctioneer
will arrange this expertise service.
By bidding for stamps which have already
been expertised or for stamps with certificates the bidder accepts the
expert marks and certificates which are available for this guidance and
inspection as decisive.
9 - No oral variations to these conditions
are valid; all alterations or additions must be in writing.
10 -Should one
of the above conditions be unworkable in whole or in part, the validity
of the other conditions will remain unaffected.
